Status as of September 29, 2026. The Executive Office for Immigration Review has published the fiscal year 2027 inflation adjustment to One Big Beautiful Bill Act fees for four Department of Homeland Security forms filed in immigration court proceedings. The new amounts take effect October 1, 2026.
The September 29 notice covers Form I-485, Form I-589, Form I-601 and Form I-821 when they are filed with an Immigration Court or the Board of Immigration Appeals. Most of the covered OBBBA fees will increase for fiscal year 2027. The initial Form I-589 asylum filing fee remains $100, while the separate Annual Asylum Fee rises from $102 to $105.

The largest increase is for Form I-485: its OBBBA fee rises by $50, from $1,540 to $1,590. The I-601 fee increases by $30, and the I-821 fee for Temporary Protected Status increases by $10.
The initial asylum fee stays at $100
The initial OBBBA fee for Form I-589, Application for Asylum and for Withholding of Removal, does not increase for fiscal year 2027. It remains $100.
The separate Annual Asylum Fee increases from $102 to $105. The two charges are distinct: the $100 amount applies to the initial Form I-589 filing covered by the notice, while the $105 amount is the inflation-adjusted Annual Asylum Fee when that separate fee is due.
The listed amounts are not always the total payment
The September 29 notice adjusts only the OBBBA portion of the fees. It does not change separate fees that DHS charges for the same forms under section 286(m) of the Immigration and Nationality Act.
EOIR says the amounts displayed on its website and Payment Portal are the combined total of the applicable DHS fee and the OBBBA fee. That means the figures in the Federal Register notice should not automatically be treated as the full amount a filer will see on the payment portal.
When the new fees take effect
The fiscal year 2027 amounts apply to relevant filings made with the Immigration Courts or the Board of Immigration Appeals on or after October 1, 2026.
The operative date is the filing date. The notice does not say that the new amount depends simply on when a form was signed, dated or prepared.
EOIR also states that it will continue to reject filings that are not accompanied by the proper filing fee or, where applicable, a request for a fee waiver.
Why the fees are increasing
The One Big Beautiful Bill Act, enacted in July 2025, created immigration-related fees collected by EOIR and requires them to be adjusted annually for inflation.
For fiscal year 2027, EOIR used the 3.4 percent increase in the Consumer Price Index for All Urban Consumers between July 2025 and July 2026.
Under the statutory formula, most of the covered fees are rounded down to the nearest multiple of $10. The Annual Asylum Fee follows a different rule and is rounded down to the nearest dollar. That produces the $105 annual asylum fee for fiscal year 2027.

I-485: the OBBBA fee increases from $1,540 to $1,590.
I-589 initial application: the OBBBA fee remains $100.
Annual Asylum Fee: increases from $102 to $105.
I-601: the OBBBA fee increases from $1,070 to $1,100.

Separate DHS fees: the September 29 EOIR notice does not change them.
